Answer: Make a Sole Application for a Divorce.

I recently appeared at a telephone hearing for a sole application for a divorce. In some cases, Court hearings can be conducted over the telephone. The divorce process is frequently conducted over the telephone which is excellent in many ways for our clients, especially ones with anxiety or ones that cannot make it into the office because they live remotely.

At times, the ex-spouse does not want a divorce. What the ex-spouse/respondent wanted in this case was to use the divorce process as leverage to gain more property and a financial benefit. Sadly, client’s have endured cases where the respondent spouse will only sign the application and necessary documents if it meant that they received the lion share of the property. This is a disappointingly common story. The no fault divorce system has been in place since 1975. Divorce is sad and can be stressful especially when children are involved. However, it is unscrupulous for someone to withhold or delay the application for financial gain, to have the upper hand in negotiations or to punish the other spouse.

Luckily, the client was swift in their instructions providing the necessary documents, such as the marriage certificate, details about children, and personal identification for their divorce application. Given our joint efficiency the application was heard within a couple of months despite the spouse not assisting with service of documents and living remotely.
